These Terms & Conditions ("Terms") govern your access to and use of SwivelChair (the "Service"). By installing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
SwivelChair turns a set of steps you provide into a live, on-screen guide. It is an assistive tool, and parts of it are produced using AI, which may be incomplete, outdated, or wrong. You remain responsible for the actions you choose to take while following a guide. Always use your own judgment, especially for anything involving money, accounts, passwords, or deleting data. We do not guarantee that the Service will be available at all times or that it will work for every website or app.
To use the Service, you may be required to provide credentials, such as an API key, to connect to the third-party providers that power it. You are responsible for keeping your credentials secure and for any usage charges billed to you by those providers. Your use of any third-party provider is governed by that provider's own terms.
We reserve the right to decline or block any use that violates these guidelines.
To operate, the Service periodically confirms access with our servers. We may, at our discretion and at any time, change, limit, suspend, or end access to the Service. We will make reasonable efforts to give notice of significant changes, but continued access is not guaranteed. Where payment is required, payments are processed by a third-party payment processor, and we may change pricing with reasonable notice.
The SwivelChair name, logo, and software are owned by us and protected by copyright and trademark law. You own the inputs you submit. By using the Service, you grant us a limited license to process those inputs to provide the Service to you and as otherwise described in our Privacy Policy.
The Service integrates with third-party providers across several categories, including AI providers, cloud and infrastructure, payment processing, email, and analytics. Your use of any third-party service is subject to that provider's own terms and privacy policy. We may add, change, or remove providers in any category at any time, and we are not responsible for the content, accuracy, or availability of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be error-free, uninterrupted, or that its output will be accurate or complete.
TO THE FULLEST EXTENT PERMITTED BY LAW, SWIVELCHAIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY ACTIONS YOU TAKE WHILE FOLLOWING A GUIDE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
We reserve the right to modify, suspend, or discontinue the Service — or any part of it — at any time, with or without notice. We are not liable to you or any third party for any such change.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts located in Chester County, Pennsylvania.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
